This “Privacy Policy” describes the privacy practices of Vitazi.AI, Inc. and our subsidiaries and affiliates (collectively, “Vitazi”, “we”, “us”, or “our”) in connection with the www.Vitazi.AI website and any other website or mobile application that we own or control and which posts or links to this Privacy Policy (collectively, the “Service”), and the rights and choices available to individuals with respect to their information.   Vitazi may provide additional or supplemental privacy policies to individuals for specific products or services that we offer at the time we collect personal information. These supplemental privacy policies will govern how we may process the information in the context of the specific product or service.

Personal Information We Collect

Information you provide to us. Personal information you provide to us through the Service or otherwise includes:

  • Business and personal contact information, such as your first and last name, email addresses and company name.

  • Feedback or correspondence, such as information you provide when you contact us with questions, feedback, or otherwise correspond with us online.

  • Marketing information, such as your preferences for receiving communications about our activities, events, and publications, and details about how you engage with our communications

Information we obtain from social media platforms. We may maintain pages for our Company on social media platforms, such as LinkedIn, Facebook, Twitter, Google, YouTube, Instagram, and other third party platforms. When you visit or interact with our pages on those platforms, the platform provider’s privacy policy will apply to your interactions and their collection, use and processing of your personal information. You or the platforms may provide us with information through the platform, and we will treat such information in accordance with this Privacy Policy.


Cookies and Other Information Collected by Automated Means  

We, our service providers, and our business partners may automatically log information about you, your computer or mobile device, and activity occurring on or through the Service. The information that may be collected automatically includes your computer or mobile device operating system type and version number, manufacturer and model, device identifier, browser type, screen resolution, IP address, the website you visited before browsing to our website, general location information such as city, state or geographic area; and information about your use of and actions on the Service, such as pages or screens you viewed, how long you spent on a page or screen, navigation paths between pages or screens, information about your activity on a page or screen, access times, and length of access.  Our service providers and business partners may collect this type of information over time and across third-party websites and mobile applications.

How We Use Your Personal Information

We use your personal information for the following purposes and as otherwise described in this Privacy Policy or at the time of collection:

To operate the Service.  We use your personal information to:

  • provide, operate and improve the Service

  • provide information about our products and services

  • communicate with you about the Service, including by sending you announcements, updates, security alerts, and support and administrative messages

  • provide support and maintenance for the Service

  • respond to your requests, questions and feedback

For research and development. We analyze the use of the Service to analyze and improve the Service.

To send you marketing and promotional communications.  We may send you Vitazi-related marketing communications as permitted by law. You will have the ability to opt-out of our marketing and promotional communications as described in the Opt out of marketing section below.

To comply with law. We use your personal information as we believe necessary or appropriate to comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities.

For compliance, fraud prevention, and safety. We may use your personal information and disclose it to law enforcement, government authorities, and private parties as we believe necessary or appropriate to: (a) protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims); (b) enforce the terms and conditions that govern the Service; and (c) protect, investigate and deter against fraudulent, harmful, unauthorized, unethical or illegal activity.

With your consent. In some cases, we may specifically ask for your consent to collect, use or share your personal information, such as when required by law.

To create anonymous, aggregated or de-identified data.  We may create anonymous, aggregated or de-identified data from your personal information and other individuals whose personal information we collect. We make personal information into anonymous, aggregated or de-identified data by removing information that makes the data personally identifiable to you. We may use this anonymous, aggregated or de-identified data and share it with third parties for our lawful business purposes, including to analyze and improve the Service and promote our business.

How We Share your Personal Information

We do not share your personal information with third parties without your consent, except in the following circumstances or as described in this Privacy Policy:

Affiliates: We may share your personal information with our corporate parent, subsidiaries, and affiliates, for purposes consistent with this Privacy Policy.

Service providers: We may share your personal information with third party companies and individuals that provide services on our behalf or help us operate the Service (such as customer support, hosting, analytics, email delivery, marketing, and database management services). These third parties may use your personal information only as directed or authorized by us and in a manner consistent with this Privacy Policy, and are prohibited from using or disclosing your information for any other purpose.

Professional advisors: We may disclose your personal information to professional advisors, such as lawyers, bankers, auditors and insurers, where necessary in the course of the professional services that they render to us.

For compliance, fraud prevention and safety: We may share your personal information for the compliance, fraud prevention and safety purposes described above.

Business transfers: We may sell, transfer or otherwise share some or all of our business or assets, including your personal information, in connection with a business transaction (or potential business transaction) such as a corporate divestiture, merger, consolidation, acquisition, reorganization or sale of assets, or in the event of bankruptcy or dissolution.

Access or Update Your Information: You may review and update certain personal information we hold about you.

Opt out of marketing communications: You may opt out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email, or by contacting us at info@vitaz.ai. You may continue to receive service-related and other non-marketing emails.

Cookies & Browser Web Storage: We may allow service providers and other third parties to use cookies and similar technologies to track your browsing activity over time and across the Service and third party websites. For more details, see our Cookie Policy.

Do Not Track: Some Internet browsers may be configured to send “Do Not Track” signals to the online services that you visit. We currently do not respond to “Do Not Track” or similar signals. To find out more about “Do Not Track,” please visit http://www.allaboutdnt.com.

Choosing not to share your personal information. The Service may contain links to other websites, mobile applications, and other online services operated by third parties. These links are not an endorsement of, or representation that we are affiliated with, any third party. In addition, our content may be included on web pages or in mobile applications or online services that are not associated with us. Security practices

The security of your personal information is important to us.  We employ a number of organizational, technical and physical safeguards designed to protect the personal information we collect.  However, security risk is inherent in all internet and information technologies and we cannot guarantee the security of your personal information.

International data transfers

We are headquartered in the United States and may have service providers in other countries, and your personal information may be transferred to the United States or other locations outside of your state, province, or country where privacy laws may not be as protective as those in your state, province, or country.

Children

As a general rule, children are not allowed to use the Service, and we do not collect personal information from them. We define “children” as follows:

  • Anyone under 13 years old

If we learn that we have collected personal information of a child without the consent of the child’s parent or guardian, we will delete it.  We encourage parents with concerns to contact us.

Personal Health Information (“PHI”)

At Vitazi.AI, we are required by law to maintain the privacy of your identifiable personal health information (“PHI”) known as “protected PHI” or “PHI”. This describes how your PHI may be used and disclosed and how you can get access to this information. Please review it carefully.

Your Rights

When it comes to your PHI, you have certain rights. This section explains your rights and some of our responsibilities to help you.

  • Get an electronic or paper copy of your medical record

    • You can ask to see or get an electronic or paper copy of your medical record and other PHI we have about you. Ask us how to do this.

    • We will provide a copy or a summary of your PHI, usually within 30 days of your request. We may charge a reasonable, cost-based fee.

  • Ask us to correct your medical record

    • You can ask us to correct PHI about you that you think is incorrect or incomplete. Ask us how to do this.

    • We may say “no” to your request, but if so we’ll tell you why in writing within 60 days

  • Request confidential communications

    • You can ask us to contact you in a specific way (for example, home or office phone) or to send mail to a different address.

    • We will say “yes” to all reasonable requests.

  • Ask us to limit what we use or share

    • You can ask us not to use or share certain PHI for treatment, payment, or our operations. We are not required to agree to your request, and we may say “no” if it would affect your care.

    • If you pay for a service or health care item out-of-pocket in full, you can ask us not to share that information for the purpose of payment or our operations with your health insurer. We will say “yes” unless a law requires us to share that information.

  • Get a list of those with whom we’ve shared information

    • You can ask for a list (accounting) of the times we’ve shared your PHI for six years prior to the date you ask, who we shared it with, and why.

    • We will include all the disclosures except for those about treatment, payment, and health care operations, and certain other disclosures (such as any you asked us to make). We’ll provide one accounting a year for free but will charge a reasonable, cost-based fee if you ask for another one within 12 months.

  • Get a copy of this privacy notice

    • You can ask for a paper copy of this notice at any time, even if you have agreed to receive the notice electronically. We will provide you with a paper copy promptly.

  • Choose someone to act for you

    • If you have given someone medical power of attorney or if someone is your legal guardian, that person can exercise your rights and make choices about your PHI.

    • We will make sure the person has this authority and can act for you before we take any action.

  • File a complaint if you feel your rights are violated

    • You can complain if you feel we have violated your rights by contacting us using the information below.

    • You can file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights by sending a letter to 200 Independence Avenue, S.W., Washington, D.C. 20201, calling 1-877-696-6775, or visiting www.hhs.gov/ocr/privacy/hipaa/complaints/.

    • We will not retaliate against you for filing a complaint.

Your Choice

For certain PHI, you can tell us your choices about what we share. If you have a clear preference for how we share your information in the situations described below, talk to us. Tell us what you want us to do, and we will follow your instructions.

In these cases, you have both the right and choice to tell us to:

    • Share information with your family, close friends, or others involved in your care

    • Share information in a disaster relief situation

    • Include your information in a hospital directory

    • Contact you for fundraising efforts

If you are not able to tell us your preference, for example, if you are unconscious, we may go ahead and share your information if we believe it is in your best interest. We may also share your information when needed to lessen a serious and imminent threat to health or safety.

In these cases, we never share your information unless you give us written permission:

  • Marketing purposes

  • Sale of your information

In the case of fundraising:

  • We may contact you for fundraising efforts, but you can tell us not to contact you again.

Our Uses & Disclosures

How do we typically use or share your PHI? We typically use or share your PHI in the following ways.

  • Treat you

    • We can use your PHI and share it with other professionals who are treating you or giving you the exam on our behalf.

    • Example: We share the results of an IDx-DR exam with the doctor treating you for the underlying condition.

  • Run our organization

    • We can use and share your PHI to run our practice, improve your care, and contact you when necessary.

    • Examples:

      • We use PHI about you to manage your treatment and services.

      • We use PHI about you to improve our artificial intelligence algorithm and for FDA required monitoring of our algorithm

  • Bill for your services

    • We can use and share your PHI to bill and get payment from health plans or other entities.

    • Example: We give information about you to your health insurance plan so it will pay for your services.

  • Help with public health and safety issues

    • We can share PHI about you for certain situations such as:

      • Preventing disease

      • Helping with product recalls

      • Reporting adverse reactions to medications

      • Reporting suspected abuse, neglect, or domestic violence

      • Preventing or reducing a serious threat to anyone’s health or safety

  • Do research

    • We can use or share your information for health research.

  • Comply with the law

    • We will share information about you if state or federal laws require it, including with the Department of Health and Human Services if it wants to see that we’re complying with federal privacy law.

  • Respond to organ and tissue donation requests

    • We can share PHI about you with organ procurement organizations.

  • Work with a medical examiner or funeral director

    • We can share PHI with a coroner, medical examiner, or funeral director when an individual dies.

  • Address workers’ compensation, law enforcement, and other government requests

    • We can use or share PHI about you:

      • For workers’ compensation claims

      • For law enforcement purposes or with a law enforcement official

      • With health oversight agencies for activities authorized by law

      • For special government functions such as military, national security, and presidential protective services

  • Respond to lawsuits and legal actions

    • We can share PHI about you in response to a court or administrative order, or in response to a subpoena.

Our Responsibilities

  • We are required by law to maintain the privacy and security of your PHI.

  • We will let you know promptly if a breach occurs that may have compromised the privacy or security of your information.

  • We must follow the duties and privacy practices described in this notice and give you a copy of it.

  • We will not use or share your information other than as described here unless you tell us we can in writing. If you tell us we can, you may change your mind at any time. Let us know in writing if you change your mind.

(“Vitazi”, “we”, “us” or “our”) uses cookies and similar technologies in connection with the www.vitazi.ai website and any other website that we own or control and which posts or links to this Cookie Policy (collectively, the “Sites”), along with any mobile applications that we own or control and which posts or links to this Cookie Policy (collectively, the “Apps”).
